Abstract
This interview with Benoit Frydman examines the role of testimony in legal evidence and the historical and comparative variations of its status. Frydman analyzes a constitutive tension: the law recognizes the importance of testimony while remaining wary of its fragility (perjury, forgetfulness, confusion). He distinguishes between the regimes of civil law and common law systems, showing that in civil law countries, testimony is transformed into a written record and subjected to the primacy of the case file, whereas in common law, orality dominates but the witness is subjected to a potentially devastating cross-examination.
