Abstract
On November 7, 2002, the Council of Europe adopted an additional protocol to the Convention on Cybercrime, the result of complex negotiations, aimed at combating the proliferation of racist and xenophobic content disseminated via the Internet, estimated at over 3,000 hate sites. Benoit Frydman explains that this new instrument represents a political compromise allowing the participation of the United States, whose delegation had opposed the inclusion of hate speech in the main treaty by invoking the First Amendment of its Constitution and Supreme Court jurisprudence protecting political freedom of expression. Benoit Frydman explique que ce nouvel instrument représente un compromis de nature politique permettant la participation des États-Unis, dont la délégation s'était opposée à l'inclusion des discours haineux dans le traité principal en invoquant le premier amendement de sa Constitution et la jurisprudence de la Cour Suprême protégeant la liberté d'expression politique.
