Abstract

Benoit Frydman proposes to examine the history of legal thought through the concept of scientific revolution borrowed from Thomas Kuhn. The author rejects two traditional narratives - that of an immobile law constituting a bulwark against revolutions, and that of a continuous progressive evolution under the auspices of reason - and argues that law, like the natural sciences, has experienced fundamental paradigmatic ruptures. By applying the Kuhnian concepts of paradigm, normal science, and crisis, he demonstrates how the very conception of juridicity has transformed across different historical periods. The modern School of Natural Law, which breaks with the medieval scholastic model based on disputatio and casuistry, constitutes the first major example of this legal scientific revolution.

Benoit Frydman propose d'examiner l'histoire de la pensée juridique à travers la notion de révolution scientifique empruntée à Thomas Kuhn. L'auteur rejette deux narratifs traditionnels – celui d'un droit immobile constituant un rempart contre les révolutions, ou celui d'une évolution progressive continue sous les auspices de la raison – et soutient que le droit, comme les sciences de la nature, a connu des ruptures paradigmatiques fondamentales. En appliquant le concept kuhnien de paradigme, de science normale et de crise, il montre comment la conception même de la juridicité s'est transformée à différentes périodes historiques. L'École du droit naturel moderne, qui rompt avec le modèle scolastique médiéval fondé sur la disputatio et la casuistique, constitue le premier exemple majeur de cette révolution scientifique juridique.
