The preface by Paul Martens argues that managerialism, by introducing axiologically neutral efficiency metrics, risks eroding the humanistic functions of justice in favour of productivity and cost reduction, particularly through quantitative performance indicators. The work highlights a central paradox: whilst the European Court of Human Rights demands both enhanced procedural protections (Salduz, Taxquet) and efficient case management, these demands frequently conflict, requiring legal professionals to actively reshape management practices so as to ensure respect for the principles of law and justice.
