Abstract

Benoit Frydman analyzes the radical critique of sovereignty developed by Georges Scelle in his Précis of the Law of Nations (1932-1934), a period marked by the rise of fascism. Scelle argues that sovereignty is a fiction incompatible with the very existence of law, which alone is sovereign, and rejects any theory of limited or shared sovereignty. Frydman situates this critique first within the context of Scelle's pacifist commitment within interwar internationalist movements, and then within the sociological conception of law that he promotes, inspired notably by Gurvitch and Mauss. Scelle proposes as an alternative a global legal order or unified intersocial law, based on global solidarity and a federalist vision of social organization. This concept, invented by Scelle, has left a lasting mark on legal theory and constitutes a seminal contribution to contemporary debates on the globalization of law and transnational law.

Benoit Frydman analyse la critique radicale de la souveraineté développée par Georges Scelle dans son Précis de droit des gens (1932-1934), période marquée par la montée du fascisme. Scelle considère que la souveraineté est une fiction incompatible avec l'existence même du droit, qui seul est souverain, et rejette toute théorie de souveraineté limitée ou partagée. Frydman replace cette critique d'abord dans le contexte de l'engagement pacifiste de Scelle au sein des mouvements internationalistes de l'entre-deux-guerres, puis dans la conception sociologique du droit qu'il promeut, inspirée notamment par Gurvitch et Mauss. Scelle propose comme alternative un ordre juridique global ou un droit intersocial unifié, fondé sur une solidarité mondiale et une vision fédéraliste de l'organisation sociale. Ce concept, inventé par Scelle, marque durablement la théorie du droit et constitue un apport séminale au débat contemporain sur la mondialisation du droit et le droit transnational.
