Abstract
This article analyzes the sociological conception of law developed by the Brussels School between 1886 and 1940, situating its emergence within the intellectual and political context of the turn of the 19th and 20th centuries. The authors show how this conception was formed in reaction to the Neo-Scholastic School of Louvain and its attempts to ground positive law in Thomistic philosophy. The Brussels School favors an empirical and pragmatic approach, based on the observation of legal and social phenomena, combined with value pluralism and an assumed relativism. This dynamic perspective conceives of law as the provisional product of a permanent struggle between social forces, and constitutes a rehabilitation of sophistry against the Platonic tradition.

Cet article analyse la conception sociologique du droit développée par l'École de Bruxelles entre 1886 et 1940, en situant son émergence dans le contexte intellectuel et politique du tournant des XIXe et XXe siècles. Les auteurs montrent comment cette conception s'est constituée en réaction à l'École néoscolastique de Louvain et ses tentatives de fonder le droit positif sur la philosophie thomiste. L'École de Bruxelles privilégie une approche empirique et pragmatique, fondée sur l'observation des phénomènes juridiques et sociaux, combinée à un pluralisme des valeurs et un relativisme assumé. Cette perspective dynamique conçoit le droit comme le produit provisoire d'une lutte permanente entre forces sociales, et constitue une réhabilitation de la sophistique contre la tradition platonicienne.
