Benoit Frydman propose une méthodologie pragmatique pour appréhender le droit global en dépassant la question abstraite de savoir si le droit global 'existe' pour analyser l'émergence concrète de nouvelles formes de régulation issues des relations transnationales et de la gouvernance mondialisée. Plutôt que de fonder son approche sur une théorie préexistante, Benoit Frydman et le Centre Perelman mènent des études de terrain empiriques dans des secteurs particulièrement touchés par la mondialisation — notamment la régulation d'Internet, le changement climatique, la responsabilité sociétale des entreprises, les litiges transnationaux en matière de droits de l'homme et la régulation financière — afin d'identifier et de conceptualiser les 'Objets Normatifs Non Identifiés' (ONNI), des dispositifs de régulation dont la nature juridique est incertaine mais qui produisent des effets normatifs. À travers des études de cas détaillées et l'examen des standards techniques, Benoit Frydman démontre que le droit global opère via des dispositifs hybrides combinant normes privées, règles publiques et contraintes technologiques, fonctionnant de manière analogue aux standards techniques dans leur élaboration par consensus d'experts, leur adoption volontaire et leurs mécanismes d'amélioration progressive.

Benoit Frydman proposes a pragmatic methodology for understanding global law by moving beyond the abstract question of whether global law "exists" to analyzing the concrete emergence of new regulatory forms from transnational relations and globalized governance. Rather than grounding his approach in pre-existing theory, Frydman and the Perelman Centre conduct empirical field studies of sectors particularly affected by globalization—including internet regulation, climate change, corporate social responsibility, human rights transnational litigation, and financial regulation—to identify and conceptualize "Unidentified Normative Objects" (UNOs), regulatory devices whose legal character is uncertain but which produce regulatory effects. Through detailed case studies and examination of technical standards, Frydman demonstrates that global law operates through hybrid arrangements combining private norms, public rules, and technological constraints, functioning analogously to technical standards in their drafting through expert consensus, voluntary adoption, and gradual improvement mechanisms.
