Stefan Goltzberg critically examines Benoit Frydman's ambitious history of legal interpretation models, arguing against Frydman's pragmatic and radical rejection of demarcation between legal and non-legal interpretation. While acknowledging Frydman's significant contribution in integrating philosophical and social scientific perspectives into legal scholarship, Goltzberg nevertheless maintains that legal interpretation possesses distinctive substantive features—most notably a particular relationship to textual literalism and a characteristic minimization of historical context—that merit recognition as meaningful differences of degree between legal and non-legal hermeneutical practices. Goltzberg contends that a properly constituted history of interpretative models would reveal legal interpretation's moderate literalism as a defining characteristic.
