Abstract
Benoit Frydman analyzes the constitutive tension between the aristocratic nature of the judiciary and its essential role in a liberal democracy. He argues that the Belgian constitutional order has established three main principles designed to democratize the functioning of justice: first, free access to justice for all as a fundamental right; second, the public nature of hearings and judicial decisions; and third, the direct participation of citizens through lay magistrates and the jury. However, the article notes that judicial institutions face increasing difficulties in genuinely accommodating the press, the media, and the institution of the jury within the democratic debate. Furthermore, they risk being further compromised by judicial management reforms which, if they do not strictly respect the principles of explicit legality and internal accountability, threaten the independence of the judiciary and the safeguarding of the rule of law.

Benoit Frydman analyse la tension constitutive entre la nature aristocratique du pouvoir judiciaire et son rôle essentiel dans une démocratie libérale. Il soutient que l'ordre constitutionnel belge a établi trois grands principes de nature à démocratiser le fonctionnement de la justice : premièrement, le libre accès de tous à la justice en tant que droit fondamental ; deuxièmement, la publicité des audiences et des décisions judiciaires ; et troisièmement, la participation directe des citoyens par le biais des magistrats laïcs et du jury. Cependant, l'article constate que les institutions judiciaires rencontrent des difficultés croissantes pour accueillir véritablement la presse, les médias et l'institution du jury dans le débat démocratique, et qu'elles risquent d'être davantage compromises par les réformes de management judiciaire qui, si elles ne respectent pas rigoureusement les principes de légalité explicite et de reddition de comptes interne, menacent l'indépendance du pouvoir judiciaire et la sauvegarde de l'État de droit.
