Abstract
This report examines the fundamental transformations of modern law in light of postmodernity. Benoit Frydman traces how legal systems have evolved from the rationalist foundations of the Enlightenment (individual rights, social contract, separation of powers) through the administrative and technocratic expansion of the welfare state, to contemporary postmodern alternatives that reconceive the role of law through economic analysis, communitarian values, or procedural ethics. The work questions how law can fulfill both its regulatory function and its role in the construction of citizenship and social meaning.

Ce rapport examine les transformations fondamentales du droit moderne à la lumière de la postmodernité. Benoît Frydman retrace comment les systèmes juridiques ont évolué des fondations rationalistes des Lumières (droits individuels, contrat social, séparation des pouvoirs) par l'expansion administrative et technocratique de l'État social, à des alternatives postmodernes contemporaines qui reconçoivent le rôle du droit par l'analyse économique, les valeurs communautaires, ou l'éthique procédurale. L'ouvrage interroge comment le droit peut accomplir à la fois sa fonction régulatrice et son rôle dans la construction de la citoyenneté et du sens social.
