Abstract

Benoit Frydman diagnoses persistent shortcomings in the quality of modern legislation — including textual obscurity, the inability to anticipate judicial reception, uncertainty as to legislative effectiveness, and rapid obsolescence — and proposes the establishment of formal mechanisms for legislative evaluation and revision. He develops an interdisciplinary theoretical model integrating the theory of legal interpretation, action theory, cognitive science, sociology, economics, and political science in order to construct a comprehensive theory of revisable legislation. The article reconceptualises legislative communication as inherently dialogic: rather than a unilateral command issued by a sovereign legislator, it becomes a space of exchange involving legislators, judges, legal subjects, and a dedicated body responsible for legislative audit and proposals for revision.

Benoit Frydman diagnostique les défaillances persistantes de la qualité législative moderne — notamment l'obscurité textuelle, l'incapacité d'anticiper la réception judiciaire, l'incertitude quant à l'efficacité législative et l'obsolescence rapide — et propose d'établir des mécanismes formels pour l'évaluation et la révision de la législation. Il développe un modèle théorique interdisciplinaire intégrant la théorie de l'interprétation juridique, la théorie de l'action, les sciences cognitives, la sociologie, l'économie et la science politique afin de construire une théorie globale de la législation révisable. L'article reconceptualise la communication législative comme étant intrinsèquement dialogique : plutôt qu'un commandement unilatéral du législateur souverain, elle devient un espace d'échange impliquant les législateurs, les juges, les sujets de droit et un organe dédié responsable de l'audit législatif et des propositions de révision.
