Abstract
Benoit Frydman compares European and American legal systems to explain the seemingly paradoxical outcome of the DSK/Diallo case, showing that common law jurisdictions such as the State of New York maintain entirely independent criminal and civil proceedings with differentiated standards of proof (beyond a reasonable doubt versus the preponderance of the evidence), whereas continental European systems such as Belgium incorporate the civil action within the criminal proceedings, with unified findings of fact. The article illustrates the fundamental cultural differences between common law procedural traditions and continental substantive approaches to legal determination and victims' rights.
