Abstract
Benoit Frydman analyzes the major challenges that contemporary transformations of the global economy pose to the classical model of the welfare state, historically based on the territorial regulation of states and the redistribution of resources produced by the market. He argues that there are alternative or complementary regulatory mechanisms to resort to when territorial regulation by states proves to be failing or insufficient, illustrated in particular by corporate social responsibility initiatives, which strategically mobilize the power of brands and reputations to regulate working conditions in global production and distribution networks. By tracing the historical evolution of global law from Roman jus gentium and Enlightenment natural law to contemporary forms of technical standardization, Benoit Frydman proposes that effective and just global governance relies on the strategic identification of leverage points or levers of action within economic networks themselves, rather than solely on the classical and declining exercise of state sovereignty.

Benoit Frydman analyse les défis majeurs que les transformations contemporaines de l'économie mondiale posent au modèle classique de l'État providence, fondé historiquement sur la régulation territoriale des États et la redistribution des ressources produites par le marché. Il soutient qu'il existe des mécanismes alternatifs ou complémentaires de régulation auxquels recourir lorsque la réglementation territoriale par les États s'avère défaillante ou insuffisante, illustrés notamment par les initiatives de responsabilité sociale des entreprises, qui mobilisent stratégiquement la force des marques et des réputations pour réguler les conditions de travail dans les réseaux globaux de production et de distribution. En retraçant l'évolution historique du droit global depuis le jus gentium romain, le droit naturel des Lumières jusqu'aux formes contemporaines de normalisation technique, Benoit Frydman propose que la gouvernance mondiale efficace et juste repose sur l'identification stratégique de points d'appui ou de leviers d'action au sein même des réseaux économiques plutôt que sur le seul exercice classique et déclinant de la souveraineté de l'État.
