Abstract

Benoit Frydman traces the radical transformation of the judicial mission since 1945, shifting from the model of executors of legislative will to that of independent arbiters of constitutional norms and human rights. While the post-war refoundation of law emancipated judges within the State through the establishment of constitutional courts and supranational jurisdictions, contemporary globalization empowers the judge as a vector for the diffusion of externally originating norms, compelling States to conform their law to international and European standards. The judge now operates in a legal space with porous borders, exercising a continuous function of review, interpretation, and discipline over State action and sovereignty.

Benoit Frydman retrace la transformation radicale de la mission des juges depuis 1945, passant du modèle d'exécutants de la volonté législative à celui d'arbitres indépendants des normes constitutionnelles et des droits de l'homme. Tandis que la refondation du droit d'après-guerre a émancipé les juges au sein de l'État par l'instauration de cours constitutionnelles et de juridictions supranationales, la globalisation contemporaine investit le juge comme vecteur de diffusion de normes d'origines externes, contraignant les États à conformer leur droit aux standards internationaux et européens. Le juge opère désormais dans un espace juridique aux frontières poreuses, exerçant une fonction continue de contrôle, d'interprétation et de discipline de l'action de l'État et de sa souveraineté.
