Abstract

Benoit Frydman critically examines transnational civil justice as a mechanism for addressing historical atrocities and human rights violations, engaging substantively with Antoine Garapon's skeptical assessment of civil litigation for historical reparations. Through analysis of the Swiss bank accounts case and other historical redress actions, Frydman employs a Hegelian framework to acknowledge that civil justice, though fundamentally limited by its reduction of suffering to monetary compensation, establishes mutual recognition of victims as legal subjects and agents. Against Garapon's philosophical preference for penal procedures, Frydman argues pragmatically that civil litigation—despite significant shortcomings regarding truth-finding and victim representation—offers effective recourse in transnational contexts where state capacity is contested and provides strategic terrain for advancing human rights protection.
