Abstract

Benoit Frydman examines impartiality as a fundamental principle of judicial organisation through a critical review of recent Belgian case law. His analysis focuses on the tensions binding this principle to other competing principles, notably the equality of citizens and the judge's right to obtain adequate information. Frydman criticises in particular the restrictive interpretation that the courts impose on the grounds for recusal, a method that paralyses the application of the general principle of impartiality by obstructing recusal whenever the appearance of impartiality is compromised. This case law also raises delicate questions regarding the self-review exercised by supreme courts in matters of recusal.

Benoit Frydman analyse l'impartialité comme principe fondamental de l'organisation judiciaire à travers l'examen critique de la jurisprudence belge récente. Son analyse porte sur les tensions qui lient ce principe à d'autres principes concurrents, notamment l'égalité des citoyens et le droit du juge à s'informer adéquatement. Frydman critique notamment l'interprétation restrictive que les cours imposent aux causes de récusation, une méthode qui paralyse l'application du principe général d'impartialité en faisant obstacle à la récusation chaque fois que l'apparence d'impartialité est compromise. Cette jurisprudence pose également des questions délicates sur l'auto-contrôle des juridictions suprêmes en matière de récusation.
