Abstract
This collective work, coordinated by Benoit Frydman and A. Van Waeyenberge, investigates technical standards and management and evaluation indicators (rankings) as growing forms of normativity that regulate contemporary social life at all levels, from the local to the global, but which have long escaped the attention of legal philosophy and theory. Combining detailed empirical studies (ISO standards, ISO 26000 certification, credit rating agencies, the World Bank's 'Rule of Law' indicator, the standardization of universities and justice) with a philosophical history of the norm tracing back from David Hume to Michel Foucault, via Jeremy Bentham and John Dewey, the volume defends the thesis that the globalization of law is accompanied by a profound change in dominant normative techniques: the emergence of management standards and indicators that compete with and supplement the classical sources of law and its traditional institutions. Rooted in the pragmatic method of the Brussels School, the book thus intends to reopen the horizon of legal scholars to these different forms of effective regulation and to the fundamental questions they raise regarding the future of our modes of governance and collective life.

Cet ouvrage collectif, coordonné par Benoit Frydman et A. Van Waeyenberge, enquête sur les standards techniques et les indicateurs de gestion et d'évaluation (classements) comme formes croissantes de normativité qui régulent la vie sociale contemporaine à tous les échelons, du niveau local au niveau mondial, mais qui ont longtemps échappé à l'attention de la philosophie et de la théorie du droit. Combinant des études empiriques détaillées (normes ISO, certification ISO 26000, agences de notation financière, indicateur « Rule of Law » de la Banque mondiale, normalisation de l'université et de la justice) avec une histoire philosophique de la norme remontant de David Hume à Michel Foucault en passant par Jeremy Bentham et John Dewey, le volume défend la thèse que la mondialisation du droit s'accompagne d'un changement profond des techniques de normativité dominantes : l'émergence de standards et d'indicateurs de gestion qui concurrencent et suppléent les sources classiques du droit et ses institutions traditionnelles. S'inscrivant dans la méthode pragmatique de l'École de Bruxelles, l'ouvrage entend ainsi rouvrir l'horizon des juristes à ces formes différentes de régulation effective et aux questions fondamentales qu'elles soulèvent quant à l'avenir de nos modes de gouvernance et de vie collective.
