Abstract
This foreword introduces a collective volume arising from the 2010 Aix-en-Provence scientific conferences, which examines how the globalization of law calls for a transformation of traditional legal conceptions and legal theory. It shows in particular that the diversification of normativities and the emergence of supranational and transnational forms of regulation pose distinctive challenges to the science of law. Rather than perpetuating the traditional opposition between analytical theories (Kelsen, Hart) and pragmatic approaches (the Brussels School, Perelman), Benoit Frydman and Jean-Yves Cherot set out to demonstrate that these two currents share common roots in the linguistic and post-metaphysical turn of twentieth-century philosophy, and that they can complement one another in conceiving the dynamic system of norms on a global scale, beyond the traditional state-centred paradigm. The implications of this theoretical synthesis are explored across the major fields of law mobilized or affected by globalization: international law, human rights, European law and constitutional law.

Cet avant-propos présente un ouvrage collectif issu des rencontres scientifiques d'Aix-en-Provence de 2010, examinant comment la globalisation du droit requiert une évolution des conceptions et de la théorie juridiques traditionnelles, en montrant notamment que la diversification des normativités et l'émergence de formes de régulation supranationales et transnationales pose des défis particuliers à la science du droit. Plutôt que de perpétuer l'opposition traditionnelle entre théories analytiques (Kelsen, Hart) et approches pragmatiques (École de Bruxelles, Perelman), Benoit Frydman et Jean-Yves Chérot proposent de montrer que ces deux courants partagent des racines communes dans le tournant linguistique et postmétaphysique de la philosophie du XXe siècle, et qu'ils peuvent se compléter pour concevoir le système dynamique des normes à l'échelle globale, au-delà du paradigme étatiste traditionnel. Les implications de cette synthèse théorique sont explorées dans les domaines majeurs du droit mobilisés ou affectés par la globalisation : le droit international, les droits de l'homme, le droit européen et le droit constitutionnel.
