Abstract
This introduction to the Philosophy of Law examines the fundamental questions of contemporary legal thought: what is justice, and how can a society establish just norms through reason? The authors distinguish the philosophy of law (which focuses on justice and rules) from political philosophy (which focuses on power), and argue that modern philosophy of law, particularly the procedural theories of John Rawls and Jürgen Habermas, abandons the ambition of abstractly determining the social contract to recognize that just norms necessarily emerge from genuine collective discussion, which the reasonable argumentation of Chaim Perelman helps to illuminate and critique. The book then examines how these principles materialize in the equitable distribution of goods, the exercise of judgment, and the protection of human rights.

Cette introduction à la Philosophie du droit examine les questions fondamentales de la réflexion juridique contemporaine : qu'est-ce que la justice et comment une société peut-elle établir des normes justes par la raison ? Les auteurs distinguent la philosophie du droit (qui porte sur la justice et les règles) de la philosophie politique (qui porte sur le pouvoir), et soutiennent que la philosophie du droit moderne, en particulier les théories procédurales de John Rawls et Jürgen Habermas, abandonne l'ambition de déterminer abstraitement le contrat social pour reconnaître que les normes justes émergent nécessairement d'une véritable discussion collective, que l'argumentation raisonnable de Chaïm Perelman permet d'éclairer et de critiquer. L'ouvrage examine ensuite comment ces principes se concrétisent dans la répartition équitable des biens, l'exercice du jugement, et la protection des droits de l'homme.
