Abstract
Alice Briegleb and Benoit Frydman examine compliance obligations in global law through the classical prism of the law of obligations. The authors analyze how compliance systems operate a transition from ex post (dispute resolution) to ex ante (risk management), encompassing technical standards and corporate social responsibility codes beyond classical legal sources. They demonstrate the transformation of moral obligations into binding civil obligations, and then examine how European instruments and judicial rulings require regulated actors to regulate the behavior of others within their sphere of influence.
