Abstract
This introductory chapter explores the tensions between artificial intelligence and the rule of law, presenting both the deep anxieties it arouses—the fantasy of the 'robot judge', 'social credit' systems imposing mass surveillance, the fear of a takeover by superintelligent machines—and the promises of algorithmic governance. The authors trace the history of this project from Plato to the 1956 Dartmouth conference, set out the definition of artificial intelligence proposed by Marvin Minsky, and discuss the resurgence of 'symbolic AI' made possible by the big data revolution at the beginning of the 21st century. The chapter thus sets the framework for a systematic analysis of the opportunities and risks that AI poses to the rule of law.

Ce chapitre introductif explore les tensions entre l'intelligence artificielle et l'État de droit, présentant à la fois les angoisses profondes qu'elle suscite—le fantasme du « juge-robot », les systèmes de « crédit social » imposant une surveillance généralisée, la crainte d'une prise de contrôle par des machines superintelligentes—et les promesses de la gouvernance algorithmique.
