Abstract
Benoit Frydman examines the emergence of global law as an academic discipline through an anecdote illustrating the institutional refusal of its recognition, revealing a fundamental epistemological issue concerning the conditions of existence of a legal discipline. The text traces the terminological genealogy from the 'law of nations' to 'international law' (a neologism by Jeremy Bentham) and finally to 'global law', each embodying a fundamental rupture with the previous conception of law beyond borders. Adopting a pragmatist approach, Frydman asserts that the univocal definition and precise demarcation of the legal corpus are not conditions but rather consequences of disciplinary emergence: global law emerges as a response to the practical transformations of globalization and as a site of ideological contestation over the conceptual and institutional foundations of law.

Benoit Frydman examine l'émergence du droit global comme discipline académique à travers une anecdote illustrant le refus institutionnel de sa reconnaissance, révélant un enjeu épistémologique fondamental concernant les conditions d'existence d'une discipline juridique. Le texte retrace la généalogie terminologique du « droit des gens » au « droit international » (néologisme de Jeremy Bentham) jusqu'au « droit global », chacun incarnant une rupture fondamentale avec la conception précédente du droit par-delà les frontières. Adoptant une approche pragmatiste, Frydman affirme que la définition univoque et la démarcation précise du corpus juridique ne sont pas des conditions mais plutôt des conséquences de l'émergence disciplinaire : le droit global émerge comme réponse aux transformations pratiques de la globalisation et comme site de contestation idéologique sur les fondements conceptuels et institutionnels du droit.
