Abstract

Benoit Frydman analyzes how globalization—conceived as a profound historical transformation operating simultaneously at the technological, economic, social, and political levels—fundamentally challenges the very foundations of law and demands its profound renewal. The author argues that law cannot disconnect itself from these developments without losing its effectiveness and social utility, and proposes a pragmatic methodology that studies law as it is actually applied in practice rather than solely in its abstract formulations. The text demonstrates how classical legal mechanisms based on state sovereignty prove inadequate in the face of transnational challenges—namely sovereign debt, banking regulation, and Internet governance—which require recourse to innovative forms of regulation, notably soft law and legal pluralism.

Benoit Frydman analyse les transformations profondes du droit engendrées par la globalisation, phénomène opérant simultanément aux niveaux technologique (révolution numérique et algorithmes), économique (financiarisation et chaînes de production mondialisées), social (dégradation environnementale et disruption digitale de la vie privée) et politique (affaiblissement du monopole normatif de l'État-nation). Ces transformations interconnectées rendent les cadres juridiques centrés sur l'État insuffisants pour maintenir l'effectivité du droit face aux possibilités d'arbitrage entre ordres juridiques et à la prolifération de dispositifs normatifs alternatifs. L'auteur propose une méthodologie pragmatique—caractéristique de l'École de Bruxelles et du Centre Perelman—qui étudie le droit tel qu'il fonctionne réellement dans la pratique plutôt que selon ses formulations abstraites, seule approche capable de rendre compte des dynamiques juridiques mondiales où plusieurs juridictions et dispositifs normatifs non étatiques interagissent et concurrencent.
