Abstract
Benoit Frydman examines normative competition—the rivalry between national legal orders as legal subjects increasingly choose jurisdictions and rules favorable to their interests—analyzing how globalization has transformed state law into a marketable commodity subject to demand. Distinguishing regulatory competition (competitive deregulation by states) from the broader phenomenon of normative competition, Frydman traces the historical origins of the concept and its contemporary manifestations through legal engineering and complex transnational instruments. The analysis reveals how non-state normativity—ISO technical standards, IFRS accounting rules, and private professional standard-setting bodies—increasingly competes with and marginalizes traditional state law, challenging conventional conceptions of sovereignty.
