Abstract
Benoit Frydman examines how technical and managerial standards increasingly compete with classical legal rules in the context of European integration and globalization. Drawing on a pragmatic approach in accordance with the method of the Brussels School, the author demonstrates that the emerging global law is characterized by a profound mutation in the forms and procedures of regulation. Traditional legal theory has long treated technical norms with condescension, considering them subordinate to the law, whereas these technical and managerial norms—ISO standards, performance indicators, benchmark criteria—now exert considerable normative influence. The author outlines a pragmatic research program designed to analyze this competition of normativities, its origins, its logic, and its functioning, particularly its impact on classical political and legal institutions.

Benoit Frydman examine comment les normes techniques et de gestion concurrencent de manière croissante les règles juridiques classiques dans le contexte de la construction européenne et de la globalisation. S'appuyant sur une approche pragmatique selon la méthode de l'École de Bruxelles, l'auteur montre que le droit global en construction se caractérise par une mutation profonde des formes et des procédures de régulation. La théorie juridique traditionnelle a longtemps traité les normes techniques avec condescendance, les considérant comme subordonnées au droit, alors que ces normes techniques et de gestion—standards ISO, indicateurs de performance, critères de benchmark—exercent désormais une emprise normative considérable.
