Abstract
Benoit Frydman presents a pragmatic methodology for studying global law by empirically examining the normative phenomena that emerge anarchically in globalized sectors (Internet, climate change, corporate social responsibility, transnational human rights litigation). Rather than presupposing the existence of a coherent global legal order, he identifies 'unidentified legal objects' (ULOs) whose legal status is contested but which effectively produce regulatory effects. The approach distinguishes between the macro-legal perspective (systemic view) and micro-legal analysis, examining how new normativities emerge through voluntary adherence to technical norms and standards rather than through traditional state legal mechanisms.

Benoit Frydman présente une méthodologie pragmatique pour étudier le droit global en examinant empiriquement les phénomènes normatifs qui émergent de manière anarchique dans les secteurs mondialisés (Internet, changement climatique, responsabilité sociale des entreprises, contentieux transnational des droits de l'homme). Plutôt que de présupposer l'existence d'un ordre juridique global cohérent, il identifie des « objets juridiques non identifiés » (OJNI) dont le statut juridique est contesté mais qui produisent effectivement des effets de régulation. L'approche distingue entre la perspective macrojuridique (vue systémique) et l'analyse microjuridique, examinant comment de nouvelles normativités émergent par l'adhésion volontaire à des normes et standards techniques plutôt que par les mécanismes juridiques étatiques traditionnels.
