Abstract
Benoit Frydman and Emmanuel Jeuland examine the tensions between the application of managerial mechanisms to judicial systems and the constitutional principles of independence and impartiality of judges. The authors analyze this phenomenon in terms of actual efficiency, validity with regard to constitutional law, and legitimacy, questioning whether judicial management constitutes a mere administrative tool or a competing alternative to the law itself.
