Abstract
Benoit Frydman examines the apparent paradox of the participation of non-professional judges in the administration of justice, establishing that this practice rests upon a transhistorical principle: the claim to be judged by one's peers. Through a historical genealogy linking Greek democracy to the English jury and to contemporary jurisdictions (juries, commercial court judges, labour court judges, the Court of Arbitration), the author demonstrates that this right to judgment by one's peers transcends differences of political regime and constitutes a recurrent response to the problems of legitimising judicial decisions. He concludes that such citizen participation embodies a culture of justice that is essentially political and communitarian, standing in inevitable tension with the modern conception of a justice grounded in legal expertise.

À travers une généalogie historique reliant la démocratie grecque au jury anglais et aux juridictions contemporaines (jurys, juges consulaires, juges sociaux, Cour d'arbitrage), l'auteur démontre que ce droit au jugement par les pairs transcende les différences de régimes politiques et constitue une réponse récurrente aux problèmes de légitimation des décisions judiciaires. Il conclut que cette participation citoyenne incarne une culture de la justice essentiellement politique et communautaire, en tension inévitable avec la conception moderne d'une justice fondée sur l'expertise juridique.
