Abstract
Benoit Frydman analyses François Gény's scientific project as a major paradigmatic break in nineteenth-century legal methodology. Gény resolutely rejects the traditional approach grounded in the philological analysis of formal sources in favour of a 'free scientific research' based on the direct investigation of objective reality and on the balancing of conflicting interests and values. The work forms part of the renewal of the modern project of constructing law as an exact science founded on reason, in critical dialogue with the emergence of the positivist sociology of Comte and Durkheim.

Benoit Frydman analyse le projet scientifique de François Gény comme une rupture paradigmatique majeure dans la méthodologie juridique du XIXe siècle. Gény rejette résolument la démarche traditionnelle fondée sur l'analyse philologique des sources formelles au profit d'une « libre recherche scientifique » basée sur l'investigation directe de la réalité objective et de la mise en balance des intérêts et des valeurs en conflit. L'ouvrage s'inscrit dans le renouvellement du projet moderne de construire le droit comme science exacte fondée sur la raison, en dialogue critique avec la naissance de la sociologie positiviste de Comte et Durkheim.
