Abstract
Benoit Frydman synthesizes three theoretically distinct yet complementary approaches to understanding law-economy relations: economic analysis of law (which risks reducing law to instrumental optimization for market efficiency and represents a modern natural law theory), Luhmann's autopoietic systems theory (which insists on functional autonomy and contingent coupling mechanisms), and Habermas's communicative rationality (which highlights law's ambivalent mediation between economic system and civil society). All three models converge on a central problem: the translation of values, data, and objectives across system boundaries necessarily involves distortion and loss, requiring neither economic reductionism nor absolute legal autonomy but rather nuanced understanding of complex systemic interactions.
