Abstract

This collective volume, arising from a 1997 conference, seeks to renew the study of the plea (plaidoirie) as an art of persuasion through speech, grounded in argumentation and in the identification of the means proper to persuading the judge. The introduction denounces the almost total absence of systematic training in pleading within universities and the bar, despite its central importance to the legal profession, and refutes the myth according to which pleading would stem from a natural gift rather than from transmissible techniques. The volume brings together contributions from judges, lawyers, philosophers and educators around three axes: the status and functions of the plea, contemporary practices according to the type of litigation and court, and training in this essential art of judicial discourse.

Cet ouvrage collectif issu d'un colloque de 1997 se propose de renouveler l'étude de la plaidoirie en tant qu'art de convaincre par la parole, fondé sur l'argumentation et l'identification des moyens propres à persuader le juge. L'introduction dénonce l'absence quasi-totale de formation systématique à la plaidoirie dans les universités et le barreau, malgré son importance centrale pour la profession d'avocat, et réfute le mythe selon lequel la plaidoirie relèverait d'un don naturel plutôt que de techniques transmissibles. L'ouvrage rassemble contributions de magistrats, avocats, philosophes et pédagogues autour de trois axes : le statut et les fonctions de la plaidoirie, les pratiques contemporaines selon le type de contentieux et de tribunal, et la formation à cet art essentiel du discours judiciaire.
